About Berriman Carpets Limited T&C’s
Berriman Carpets Limited aims to always give you the best possible value and service. The following Terms and Conditions on our website will explain how we will deal with your order and you should read them carefully. The information on this website is given in good faith and Berriman Carpets Limited cannot accept responsibility for any loss or damage arising from the information or its use or misuse.
Your Order & Cancellations
When you place an order, you are inviting us to enter a contract with you to supply the products you have selected at the price indicated on your invoice. When we receive your order and the goods have been paid for in full. We will send an acknowledgment email direct to the manufacturers to order the flooring chosen by you, if the carpets and other floor-coverings have been cut or scheduled for delivery, cancellations cannot be accepted. If you have provided your own measurements, you are responsible for these being accurate and Berriman Carpets Limited accepts no liability if the floorcovering does not fit. Therefore, please make sure that these are correct at the time of ordering to avoid any issues upon delivery or when the floorcovering is fitted.
Liability
While we try and get things right first time, occasionally things don’t go according to plan. Subject always to your statutory rights, if your floorcovering is not of satisfactory quality or is not fit for a purpose which was made known to us, we will replace any defective floorcovering and arrange for the defective floorcovering to be uplifted and disposed of straight away. If there is a problem with the fitting that gets arranged and are referred to in these terms and conditions, we will ask the self-employed sub-contracted fitter concerned to revisit your property for the fitter to carry out any necessary remedial works. This may be referred to as a ‘SNAG’.Any contract for fitting is between you and the independent self-employed sub-contracted fitter. This does not affect your statutory rights. Your self-employed sub-contracted fitter personally guarantees their workmanship for 12 months from the installation date. This covers installation errors (e.g., loose plates, one complimentary carpet re-stretch).
Exclusions: This guarantee strictly excludes issues caused by environmental changes in your home, including:
LVT & Laminate shrinkage caused by underfloor heating exceeding 27°C. Gapping caused by direct sunlight/heat (e.g., in conservatories). Damage from damp/moisture unless a new DPM was installed.
This provision does not affect any liability we have for fraud or fraudulent misstatement or for personal injury arising out of our negligence.
Fitting (Floorcoverings) & Introduction to Independent Fitter
If you wish for us to arrange for your floorcoverings to be fitted, we can supply you with a list of qualified trained carpet, vinyl, laminate and luxury vinyl tile (LVT) fitters, all fitters on our database are independent self-employed sub-contractors which specialise in either carpet and vinyl’s, laminate or luxury vinyl tile (LVT), they carry their own individual public liability insurance and independently guarantee their own work. If you would like for us to arrange fitting of your floorcovering then we will request that one of the independent self-employed sub-contracted fitters from our database is given your full details and will attend your address to install your floorcovering on a date that is mutually convenient for both parties which will be agreed upon when purchasing your floorcovering.
Furthermore, where Berriman Carpets has been asked to make the arrangements for your floorcoverings to be fitted, we agree to act as your agent for this service and a fitting arrangement service per m2 is chargeable. As a good will gesture this is done FOC (free of charge). This includes an introduction to an independent flooring fitting specialist and arranging the installation of your purchase under a separate contractual agreement between you and the fitter. It also includes monitoring fitting standards, arranging a pre-cut service to aid an efficient and speedy ‘at home installation’, and on the rare occasion of a complaint being raised regarding the fitting, Berriman Carpets will manage the complaint between yourself and the fitter.
By agreeing to these terms you also agree to pay the independent self-employed sub-contracted fitter for the fitting services upon completion of the fitting, unless the fitting is taking place on different occasions, in which case you must pay the self-employed sub-contracted fitter for the work completed on each occasion (for example, if a lounge, hall, and dining room carpet are fitted in months 1, 2 and 3, as part of a home refurbishment, you must pay the fitter the relevant proportion of the fitting charge upon completion of fitting each room). Alternatively, you may make any other arrangements for fitting the product yourself.
Disposal of New & Old Carpets
It is your responsibility to uplift your existing flooring prior to the independent self-employed sub-contracted fitter arrival. Your self-employed sub-contracted fitter will then bag up any offcuts from your new flooring where possible and leave them for you to dispose of. If you would like to keep any offcuts, please advise your fitter upon arrival at your home. Your self-employed sub-contracted fitter will move up to five pieces of empty furniture from your room. This does not include white or electrical goods, pianos, antiques, or items over 4ft in height, please ensure that these items contents are cleared prior to the fitting date to avoid any delays or inconvenience with your fitting. If you request that the self-employed sub-contracted fitter moves or removes any of the above mentioned non-included items and the fitter decides that they will accommodate you and move them then you understand that the self-employed sub-contracted fitter will not be liable for any damage caused in moving those items, you accept full responsibility for any damage caused and in any case Berriman Carpets Limited accept no responsibility for any damage incurred. Any waste from the fitting which includes tubes, inserts, wrapping, used grippers, carpet rods and any other waste associated with the fitting or uplifting/removal of any carpet and/or floor covering will not be removed by the fitter or Berriman Carpets Limited and is your responsibility to remove and responsibly dispose of the waste yourself.
Uplifting old floorcoverings & Removal
If you require an uplift and removal of any old floor coverings as well as new floor coverings to be fitted, please mention this at point of sale to the member of staff taking your order, this will be an additional charge.
Floorcoverings Completion
Please inspect the completed work with your self-employed sub-contracted fitter before they leave, this is known as a “walk round”, They will have a walk around check sheet for you to sign, during the walk round your self-employed sub-contracted fitter will ensure that you are happy with the service received, it is then your responsibility to ensure that any issues are addressed whilst inspecting the completed work. Your self-employed sub-contracted fitter should be able to address any issues which are identified. If a problem with the fitting manifests itself after the product has been fitted, please either contact your self-employed sub-contracted fitter directly or in the first instance, please let Berriman Carpets who are acting as an agent arranging the fitting know if there are issues, we will then raise the issue with your self-employed sub-contracted fitter.
Damage & Scuff Marks
Fitters undertake and to carry out their work with reasonable skill and care, but even with the greatest care home décor may be marked or scuffed during the fitting process. New paintwork and wallpaper are especially vulnerable and should be allowed too fully dry. A minimum of two weeks is recommended. No fitter will undertake or carry out any redecoration, except where damage has been caused by that person’s negligence, should any negligence occur, it will be the responsibility of the independent self-employed sub-contracted fitter to remedy. Berriman Carpets Limited will work with you to resolve any problem you may have with the fitter but take no responsibility for any damage by doing so. Berriman Carpets Limited may take the route of removing any fitter from their approved database if they refuse to mediate with you. At all times the contract for fitting any floorcovering remains between you and the independent self-employed sub-contracted fitter.
Door Trimmings
Doors may need to be trimmed to allow clearance. This is not a service we provide however we can arrange for doors to be trimmed by a self-employed joiner. We may require over one week’s notice to arrange this, depending on how busy we are. The fitters may need to remove doors to facilitate there fitting and have them ready for you or your appointed carpenter to trimming and re-hanging. If you have fire doors which need trimming, you will require a specialist carpenter, and this is not a service Berriman Carpets Limited offer. We are also unable to remove fire doors and so you will need to arrange this prior to your install. Please note: If a door does not clear the new flooring height, the fitter will NOT re-hang the door. It will be left safely in the room for you to arrange trimming. Under no circumstances will a fitter force a door back onto its hinges if it rubs the floor, as this damages the new carpet/floor immediately.
Fitting Times
Fitting and estimator appointments are made in good faith. The exact time of arrival cannot be guaranteed nor can the duration of the install due to the nature and unpredictability of the work involved. We cannot accept liability for late arrivals.
Subfloor Preparation
Some subfloors, especially luxury vinyl tile (LVT) not withstanding carpet or any other floor covering product may require preparation before being fitted. We provide a subfloor preparation service at an extra charge. We do not guarantee that this will make a subfloor entirely even or level and consequently cannot be held liable. If a subfloor has not been prepared, we cannot be held liable for imperfections to carpets and other floor-coverings being fitted to imperfect subfloors. We may sometimes liaise with one of our designated sub floors manufactures to do a home visit to ‘spec’ the job, we would then follow there instructions on how to prep the subfloor and any warranties would then be granted via the designated sub floor manufacturer, a copy of this can be requested and given to you at any time.
Payments
We require payments in full prior to your fitting date and this needs to be paid no later than one week before your installation date. We accept all forms of payments – Cash, Card & Bank Transfers. We don’t accept American Express.
Customers own measurements
Should a customer contact us providing us with the exact type of carpet or floor-covering they require along with their own measurements of areas to be fitted, we will make allowances on these sizes and place an order. We cannot be held liable for carpets or floor-coverings that do not fit if customers have provided us with their own measurements that prove to be in-correct.
Carpets
The samples we display in our stores are intended to give a general impression of the colour and pattern of the carpet. When fitted in a larger area some patterns and seemingly random blends of yarn can have an inherent striped effect, or additional patterns and colours which may not be obvious from the sample. Colours vary from batch to batch and exact matching between separate pieces (especially from multi-width rolls) cannot be guaranteed. All carpets are cut at 10cm intervals with a minimum order length of 1 metre. All sizes are approximate and within a tolerance of plus or minus 1.25% in accordance with British Standard BS3655. If your room is close to the nominal width of the carpet, please allow for extra in case a join is required. During transportation and storage, the pile may become flattened slightly and this will show as shaded bands across the pile or as a ‘pole mark’. These will disappear as the carpet settles into its new environment and the pile is flexed through regular use and vacuum cleaning. If the lines do not disappear within a three-week period, please contact us.
Carpet is a soft, luxurious product and flattening of the pile will occur. Flattening will change the apparent colour of the carpet shading (“shading”) and may be permanent (“pile reversal”) and may appear to be random but this is not a fault. Areas where foot traffic twist and turns are especially prone to changes in appearance. High traffic areas such as in front of chairs, beside the bed and in doorways are relevant examples of where the deterioration of appearance may occur. All carpets benefit from the use of good quality underlay. Re-using existing underlay may result in abnormal flattening of the pile. We recommend the use of vacuum cleaners with rotating brushes on cut pile carpets and suction only for loop pile carpets. Deeper pile saxony carpets will require additional vacuuming.
Vinyls
All vinyl flooring is cut at 10cm intervals with a minimum order length of 1 metre. All sizes are approximate and within a tolerance of plus or minus 1.25% in accordance with British Standard BS3655. If your room is close to the nominal width of the vinyl, please allow extra material. If you require the installation of your vinyl flooring below non-integrated appliances, please ensure these are removed from the room prior to the self-employed sub-contracted fitter’s arrival.
Laminate Flooring & Luxury Vinyl Tile
Our in-store samples show only a small part of the overall design as this will have been taken from a larger piece. There may be a significant variation in the colour and design of your floor due to the random nature which occurs with wood and other natural materials, from which the design has been taken. We believe this enhances the natural look and overall appearance of our floors. The supplier’s fitting and maintenance instructions should be carefully followed to prevent swelling of the joints or other expansion problems. It is the customer’s responsibility to ensure the packs of flooring are stored in the room they are to be fitted in for at least 48 hours prior to installation. The room must be kept at a normal living temperature (18°C – 22°C). If the packs are left in a cold garage or conservatory until the morning of fitting, the manufacturer’s warranty is void, and Berriman Carpets & Flooring accepts no liability for subsequent shrinkage or gapping.We recommend not to use a steam cleaner or any LVT or laminate flooring as Laminate and LVT flooring will be affected by moisture; wet mopping will likely damage the flooring beyond repair. For further information, please speak to a member of our team in store. Whilst many of the products we sell are available to purchase in square metres, our luxury vinyl, laminate flooring products are purchased by the box. When estimating appropriate floor coverage for your installation, we will apply a percentage between 5-15% (rounded to the nearest box) to your order to allow for colour matching between boxes and wastage during fitting. In the case of a herringbone installation, this tolerance may be increased further based on the manufacturer’s recommendation. If a subsequent order is placed, we cannot promise this will be supplied from the same batch as that previously supplied.
Product Guarantees
We are responsible for ensuring that the goods we supply are of satisfactory quality, conform to the sample and are fit for the purpose for which they are sold. Certain products have additional guarantees provided by us or the manufacturer. Where they are provided by the manufacturer, we accept no responsibility for these additional warranties or guarantees. The length of our wear guarantee varies from floor to floor as each one is different. All manufacturers’ wear guarantees do not relate to the appearance of the product but are specifically in relation to being ‘threadbare’. With reference to vinyl, laminate and LVT, over time the appearance of your flooring may deteriorate depending on your usage, demands and after care, but this will vary from home to home. Surface stains, scratches, abrasions, and marks are not covered by the wear guarantee. Whilst regular cleaning will help to keep your floor looking good, normal wear and tear is to be expected. Any damage which has occurred due to negligence, malice, removal, fire, water damage and similar events will void the warranty.
Fitting Guarantees
All independent self-employed sub-contracted fitters that Berriman Carpets use offer a 12 month guarantee from the date of your completed fitting date. This covers:
